Cease and Desist Letter for Debt Collectors

Use this letter to stop debt collectors from calling you. Once the collector receives your letter, the FDPCA allows the collector to contact you one final time, in writing, to let you know what action, if any, the collector will take next. See bottom of page for easy  instructions.

Dear Debt Collector:

Pursuant to my rights under the FDCPA, I am demanding you immediately stop communication with me, and my family, friends, and employer regarding this and all other alleged debts you are attempting to collect from me.

I am refusing to pay this alleged debt.

If you are claiming I ever consented to receive calls on this number, while I deny that I did, I hereby revoke that consent pursuant to my rights under both the FDCPA and the TCPA regarding this number and all alleged debts you claim I owe and/or you are attempting to collect from me.

If you do not comply with this demand, I will pursue all legal claims I may have against you.

Read these all the way once before doing anything.

1. Copy and paste the above information into your favorite text document (ie Google Docs or Microsoft word) or write the letter neatly by hand.
2. Put in  your information including:
   1. the  current date,
   2. your name,
   3. address,
   4. the debt collectors name and address
   5. (in the Re: line) account number given by the debt collector
   6. your phone number
3. Make a copy of the letter.
4. Go to the post office to mail and they will show you how to send the letter certified mail return receipt requested (green card). Write your address on the face of the green card.Bring these instructions with you if you’re not sure what to ask them at the post office. It will cost $3-4. It’s worth it
5. Write the return receipt number on the letter before you send it.
6. They will give you a receipt.
7. Bring that home and staple to your copy of the letter .
8. When the green card comes back also staple that to your copy of the letter. You now have proof you sent it and that they got it.
9. Keep the copy in a safe place.
